Arbitration Agreement

1. Agreement to Arbitrate

By receiving medical services from International Pause Institute ("the Clinic"), you ("the Patient") agree that any dispute, claim, or controversy arising out of or relating to the services provided, including but not limited to medical malpractice claims, will be resolved exclusively through binding arbitration. This means you waive your right to bring such claims to court, including the right to a jury trial.

2. Scope of Arbitration

This agreement applies to all disputes between the Patient and the Clinic, its employees, agents, successors, assigns, and any associated healthcare providers. It encompasses, but is not limited to:

Claims related to diagnosis, treatment, or care. Disputes concerning the interpretation or application of this agreement. Any claim arising from acts or omissions that result in personal injury or medical expenses.



3. Arbitration Procedures

Initiation: To initiate arbitration, the aggrieved party must provide written notice to the other party detailing the nature of the dispute and the relief sought.

Selection of Arbitrator: Within 20 days of receiving the notice, the responding party may appoint an arbitrator. If they fail to do so, they consent to the claimant’s appointed arbitrator. The two arbitrators will then select a third arbitrator to serve as chair. If they cannot agree, the American Arbitration Association (AAA) will appoint the third arbitrator.

Rules: The arbitration will be conducted in accordance with the AAA's Commercial Arbitration Rules and the Supplementary Procedures for Large, Complex Disputes.

Location: The arbitration will take place within 50 miles of the Clinic's offices.

Discovery: Each party may request relevant documents from the other. All discovery must be completed within 60 days of appointing the final arbitrator. Depositions are limited to three per party, each lasting no more than three hours.

4. Costs and Fees

Each party will bear its own costs, fees, and expenses, including attorney fees. The parties will share the arbitrators' fees and expenses equally.

5. Binding Nature and Enforcement

The arbitration decision is final and binding. Judgment on the arbitration award may be entered in any court with appropriate jurisdiction.

6. Patient's Right to Cancel

You have the right to rescind this agreement by providing written notice to the Clinic within one (1) calendar week after signing. To rescind, write "cancelled" on a copy of this agreement, sign your name, and mail it by certified mail, return receipt requested, to the Clinic within the one-week period.

7. Governing Law

This agreement is governed by the laws of the State of New Jersey and the Federal Arbitration Act (9 U.S.C. §§ 1-4).

8. Severability

If any provision of this agreement is found unenforceable, the remaining provisions will continue in full force and effect.

9. Acknowledgment

By accepting services from the Clinic, you acknowledge that you have read, understood, and agreed to the terms of this Arbitration Agreement. You also confirm that you have had the opportunity to ask questions and seek legal counsel regarding this agreement.
